Hi, can anyone tell me what the requirements are for converting an L1B to L1A visa? I know a couple of people who have done this and believe you have to have some management experience in your home country but how much and does it have to be with the company you worked for in the UK are now working for in the US? Or could experience with previous company count.
Obvoiusly it is desirable to do this if possible since it avoids labor certification and thus saves about 2 years in processing time!
Thanks
Hi there! welcome to the board.
We did this. You have to prove that you're a manager here. This doesn't have to be a manager of people though -it can be a process. You just have to be in charge of/responsible for something. Best to use company lawyers if possible. smile
Thanks monster - that is useful information.
I have some management experience here in the US so that is probably ok. What about experience in the UK though - would management of a process count there too? Do you know of any time constraints (like 1 year experience etc?)
It's not so much experience but what your job in the US entails -whether you are a "manager" here (of a person/process...).
I think there are criteria regarding past experience, etc, but don't know what they are, though. The lawyer put in a resume/CV for Beest (my other half) with the adjustment of status application thingie.
Tried it and got rejected. I went from managing no-one in the UK to managing 15 people in the US. It was rejected because I wasn't "managing" anything in the UK.
Got my green card eventually though!
