So, we have decided that we want to relocate (emigrate) to the USA next September. (Me UKC; wife US/UK dualie.)

What, in people's experience and opinions, would be the optimal month to lodge the initial petition (I130) with INS in London, to allow the visa to be granted in, say, July or August..? (To allow time to sell our house.)

Thanks!

Stuart
ouch youre gonna have some probs .. recomend you go look at some of the ins sites ..others will give you good links i hope.. if not i'll pull my files out ...its bloody amazing how much paperwork we accumilate here.. and i only have my green card .... citizenship is going be fun..

remember that your appointment is going to a minimum of 5 weeks for the american embassy ..after you sign there stupid check list of paperwork.. Biggest advice .. GET COPIES OF EVERYTHING .. they will keep copiess as long as they can see the originals..

also get your police report from this country now it can takes 3 0r 4 weeks in some countires.. If you have lived in other countries for more than 6 months you need a police report from those countries too..
i don't think it mater which month you choose ..its seems busy all the time ..but don't quote me..

... September *next* year, so allowing over a year!

smile
plenty of time i'm sure ..but i can't spell this out any clearer ..keep i log of everything you do and copy everything ..it really helps ok.. check out the sites and histories of others who have done it ..there are a lot of case stories out there ...
its can be done easily without the dam lawyers .. just read up and talk it slowly ..question where are you going to move to in USA ..
If you are coming over here on your wife's merit then I would say the sooner the better.

If you are coming over here through a job, then depending on what visa you are wanting depends on whether they restrict the number of visas issued or not. For instance, if you are looking for a job now and will be going for an H visa, they limit the number of these that are issued every year and the new year starts November (I think).

And antbax, is right, keep copies of all paperwork. You will need a huge file!
i came into usa on a k1 visa and hgad to marry within 3 months .. or get sent out lol

luckily that route is not for you... probably a little easier in time scale..
it was deadlkine deadline for me ..as wedding date was booked etc ..

It takes about 3 months to get the visa, but you can easily extend this time yourself.

I'd say that, given you aren't in a hurry, you should file the petition about 6 months from the date you want to leave. It will take the INS about 4-6 weeks to approve the petition; the approval will be valid for 4-months (you have to have the interview before the petition expires); once the visa has been granted, you have 6-months to enter the US.

Thanks for that, Ameriscot.
