No wait its not for real .
I was taking part in a cadet training progame last dayof the course they had to do a mock crime scene with participants acting out the *victim and perpertrator *
I was asked to be the *alleged criminal *as they wanted a person with a accent and a visitor to the US i know the local judge and she asked me if i would do it .
the trial is fri morn ,should be interesting as they didnt get a confession and *as far as i know gather much evidence * just the victims word that her assailant looked like me and drove the same truck (supplied by the police dept )* .the script was much longer than that but i think they screwed up and arrested me before getting any answers to there questions, as soon as they did that i screamed for a attorney, didnt say anything else and the exercise was over, now they have to somehow put a case together .
the top notch attorney defending me is going to say my rights /cicvil liberties where violated and i was picked on cause i was from another country .
apparantly that scenerio is a biggy nowadays in police training colleges .
Very interesting .
i cant wait til fri for the trail ,the jury will be 12 citizen volunteers from our city .the judge, jury and attorney as well as myself and the victim all are giving our services for free .
what with this and my stint as santa on sat i have a very busy week ..
So they told you it was a cadet training programme eh? They'll do anything for a conviction these days.
-)

Yep, and it is to be followed by the 20 year prison guard training program....
sounds fun John, you'll have to report back on the trial.
Professionally, I'd also be interested on how the whole exercise affected your views of the criminal justice system.

HEHEHE yeah i wonder what other lies they will come out with in the trial.
I was told in fact that most folks when arrested *if quilty* do speak to the police after with out a attorney .is that true in your opinion true ???

Absolutely. And so do the innocent, often to their detriment. Many people think that if they have not received the Miranda warning they can speak to the police and the statements will not be admissable. They almost always are!
The Police no this and obviously take advantage of the situation.
I've even had cases where suspects demand the "right" to speak on tape or provide signed statements... then tell me later that they want me to get this stuff excluded.
Another favorite is parents who tell things to the police when there kids are suspected of a crime: "yeah he told me that he spray painted the neighbor's car and stole his IPOD, but I gave him a time out so thats ok now.....".
Just so you know, parents can be forced to testify against their kids.
Sounds interesting.
Maybe people react differently when they are caught unawares by the arrest?
I liked your approach though - the legal advisors I sometimes work for advise students here to co-operate but say almost nothing when arrested by the police.

If the police have any reason to believe you are suspected of a crime, the only reason the police have for talking to you is to gather evidence. Anything said to them could be incriminating.
John you better check that zip code to make sure u do not end up on it lol
Blimey johnA, what the hell are you smoking. Are you nuts. I mean, community spirit and all that, but you're living in the land of fantasy, ie Texas, make sure they know it's not real or you'll never be Santa again. Take care and let us know how it goes.
My attitude is always to say, Why are you asking me that, do I need a lawyer, is this racist, At my age you think I have the energy for any of this?
I used to have great respect for the local force, but we got an east coaster in when the good guy left and his attitude is, only panic and do something if they're millionaires. Stopped our donations told em I wasn't happy. Bit sad really but it's a general feeling. East coast cops have no feeling. They just want to score points.

So you've been fired from the Santa at the petshop gig then?
/baaaah
Not sure I would be happy participating in a mock trail especially with the offense you have been charged with.
I hope everything works out.
Do they still Tar and Feather in Texas? Just in case get in plenty of turpentine.

no it is a bit sick.
but like the instuctor said its no use having them do a mock incident that is a minor charge like breaking the speed limit etc .this is a hard one to investigate , prosecute ,and convict .
the top notch attorney defending me is going to say my rights /cicvil liberties where violated and i was picked on cause i was from another country .
I'll have to remember that for next time I get arrested. That whole civil rights violation thing seems to act as a get out of jail free card.
DID NOT go to jail fri case was throw out by the judge -)
Did resemble santa sat morning at petsmart .
Did go to see the nutcracker suite *ballet * sat night with my Wife.
Will watch nfl foofball most of sunday
