Hi There, (waves...)

To anyone who has experienced the following - your advice would be greatly appreciated; (and thanks for your advice, so far Pilgrim....)

A friend maybe considering hiring me, to work for him, duly. As I am already in the Country (US), can you tell me what his obligations are as an employer and in reference to getting the work authorisation process started? He has never been through the sponsoring process before and needs a rough idea of the do's and dont's!

Does he have to apply for the H1B, H2B for me?

And is being offered a job while in the US on VWP, then filing for AoS an acceptable, while the employer (my friend) files for work authorisation an acceptable route to take in the eyes of the USCIS? Is there a possibility of deportation?

Will I be able to change employers and transfer my work permit to a new employer (should I need to) or am I obligated to my initial employer until the end of the agreement/contract?

you cannot AOS from Visa Waiver (as a norm, you can through certain loopholes) but not onto a H type visa.

Also the H visa's have a quota and I believe they are all taken for year 2007 so he'll need to apply for you in and around April 2007 for October processing for the 2008 year allotment.

As the quota for H1B's has already been reached for 2007, is there not an alternative or any other work permit that the Employer can file for at present? Or can he not just request work authorisation for me.
