Hi all,

I am just looking for thoughts on whether I should worry or not.

My partner is here on an H1B visa. He was out of work for about a year. He found a new job, H1B visa work authorization was transferred and he went to Canada and returned after receiving this authorization. Currently awaiting Labor Certification for Green Card and employer received 45 day letter the other day. A few months ago, 7th year extension was approved.

His current visa stamp is expired. Should he take the chance and get a new stamp, or just wait out the process. His attorney believes that there is not much of a chance of the visa stamp being denied, but being an American, I understand how the bureaucracy works.

According to the lawyer, obtaining the authorization is almost like receiving a clean slate (paraphrasing). Though he was out of work, he never stayed beyond the date on his I-94, which from what I have read is important.
