Ok I am so angry right now evil . I am a brit married to an american, I came in on a fiance's visa. For any who don't know basically you have 90 days from entry on this visa to get married in the USA, which we did. The visa then become void so you can't reenter if you leave. So next step was to apply for an adjustment of status (I-485) where restrictions are lifted you can travel, get a residency card etc. So I filed in Jan 2005, normal processing is 120-180 days. Oh noooooo, no they are still working on June 2004!!!! Because of this I have missed two sick reletives who have now passed, weddings and I have a niece or nephew due to arrive in Feb, oh and I would like to take a weekend cruise with some friends and I can't. Another pain in the ass is that NC have changed their laws for driving licences (yup never learnt in blighty, never needed to) I have two kids now and I need to be able to but cannot until I get my residency card as that visa expired on entry!!! FRUSTRATED as hell evil !!!!!!!!!

What is the earliest they will issue a Temporary Parole document? I'm probably not using the correct terminology there but it is a document that lets you come and go while you are being processed. I recall applying for one when I filed the adjustment of status froms and enclosing a letter, explaining that my grandparents probably would not last much longer.
I had that approved and had to go collect it in person. In the end, I did not have the money to go back for any of the funerals but I was pleased that the US immigration services gave me the opportunity to do so.

Advanced Parole is what you are referring to and yes it is an option I was trying to pursue when my Grandmother took a turn for the worse, I had to obtain proof from her doc to support my application then when I called they told me there was a backlog for that too!!!

The idea behind this was that it would accelerate processing times. (Do they ever accelerate anything?? :roll: :evil: ) According to reports, the average processing time for AP applications from the Chicago lockbox is approx 2 months.
I came the same route as you (K1) in 2001. You'd have been very fortunate if your AOS had been processed in 120-180 days. I've rarely heard of anyone's AOS being processed in such a short time.
I know it's frustrating, but hang in there. :smile:

A royal pain in the arse if you ask me! mad It says on the UCIS site under my sub office of Charlotte, NC that Advanced Parole is for emergencies only and when I last called UCIS they told me I needed supporting evidence.

How long ago did you do that Monster? Things changed in 2001 and even more so in 2003. It's just so much money to pay out for my son and I when my !-485 should have been completed by now.
I submitted my AOS application last year in June (I think, might have been July). My attorney applied for Advanced Parole and Work Permit for me at the same time. Those came through by the middle of August, I believe. I had my AOS interview in July.
In the 5 years I've been in this country I've come to understand that the various DMVs know very little when it comes to immigration.. I was told a couple of times that I couldn't renew my license or that I needed to go elsewhere... sometimes just finding a nicer person at the DMV helped get things sorted.
Can you apply for AP? My attorney put on my application that I needed AP to travel for work and because I had family in England who I needed to be able to reach at short notice.
I just cannot justify paying more money because they are slackers! Arrggh mad can you tell how much this gets to me! I don't have a lawyer doing mine, hubby and I have done it all ourselves and have been successful so far. As for the DMV here in NC a new law went into effect thanks to the mexicans that you have to provide a valid Visa as one of the conditions to obtain one, or a residency card and that is where I am stumped don't have either.

Did you not get a receipt when you sent in your AOS paperwork? Have you tried showing that to the DMV? The NJ DMV let me use a receipt for my H1B years ago in lieu of a visa.

Stelesque you may have something, I think I'll email the DMV and fins out instead of queueing a whole day only to find it doesn't count, I hate that.
Not sure if this will help. I was in a similar situation when I applied for adjustment of status and advance parole - I ended up missing my own wedding reception in the UK so I empathise with you. But once my application had been pending for 90 days, I was able to appear in person at the INS in NY (had to wait in line from about 3am mind you and the whole process took about 15 hours but I walked away with my advanced parole). I know each place and situation is different, but you might be able to look into whether this approach could work for you.

Advanced Parole Document, trick is to hire a lawyer to care of all this crap for you. My document was not delivered, I could not talk to INS but my lawyer could. Seems as though it was left on a persons desk , signed, sealed but not delivered. Fees for my immigration were $1000....absolute bargain. I think I went to the UK 4 times while my claim was being processed.
