Full Version: URGENT QUESTION RE: I-130 PLEASE

I AM BRITISH AND HUBBY IS AMERICAN. WE GOT MARRIED IN UK 15JAN 2005 HERE IN UK AND POSTED I-130 OFF TO TEXAS BENEFIT CENTER. WE RECEIVED NOA 28FEBRUARY SAYING GO TO WEBSITE FOR MORE INFO ETC. THE WEBSITE SAYS IT IS TAKING 990DAYS TO PROCESS THIS VISA TYPE. IS THAT CORRECT? LAST DECEMBER WE HAD GONE FOR I-130 INSTEAD OF K3 AS WE WERE TOLD K3 WAS THEN TAKING A YEAR AND A HALF AT LEAST DUE TO BACKLOG?

WHAT IS GOING ON? DO THEY EXPECT US TO LIVE SEPARATELY FOR OVER 3YEARS UNTIL VISA COMES THRU?

IF I GO TO USA AND STAY ON BRITISH 90 DAY TOURIST VISA, WOULD I BE DEPORTED??????? I AM REALLY UPSET WITH THIS 990 DAY MATTER AND WOULD LIKE IT CLARIFIED BY SOMEONE WHO KNOWS HOW THINGS REALLY OPERATE THERE.

ANY ADVICE WOULD BE REALLY APPRECIATED. THANKS

I'm not sure I can help much because I'm not going to be around.

But I'm sure others on here can and will.

However you might need to provide more info.
Where are you living (UK or US)?
If the UK why did you not go through the Embassy? (by far the quickest route at about 3 to 4 months I think).
If in the US (as I suspect is the case) - on what basis were you in the US prior to marriage?
As to coming over on a 90 waiver - if you are considering coming and then overstaying - DON"T! you could get banned from the US altogether as well as deported. :o

Finally. Many people on this site, including myself, moved here with an American spouse. The process is stressful, but you will get there, I doubt there is anything I can say that will make it less stressful, but others have gone before you and survived. :D

Hi Jacky, welcome to Britnet. Someone here will surely know the answers, but please don't post all in caps -it is considered shouting on the internet, and more importantly, makes it very hard to read. :)

In my experience (which is on a work visa not a marriage visa and through Nebraska) the processing times listed on the websites were reasonably accurate. It took nearly three years to get our greencards approved and we still don't physically have them.

On the plus side, there are many people on the internet who know an awful lot about this process and will be able to tell you if the website is accurate in your case and what you can do to speed it up/while you wait.

Try this site: Visa Journey -I have heard that it is excellent for help with marriage-based visas to the US.

I just looked on Visa Journey and it looks like Texas are sending them elsewhere to be processed and it's not actually taking very long, but I could be mistaken.
