I am currently in the US going through the AoS and have EAD (orignally had H4 visa and husband H1B), but I want to go to university autumn 2005. Would I need to apply for a student visa or does the AoS process allow you to study as well as work?

As long as you are legally here you can study in the US. You don't need to go for a student visa to do so. BUT, each state has different regulations on how much you will pay - whether you pay the local rate or 'out-of-state' rate. I am allowed to pay in-state fees because my husband was on an L1 (I was an L2), and now in AOS, but I know someone in another state has to pay the 'out-of-state' fees because they are on H visas. My state university has a website which gives a lot of info for resident and non-residents. Maybe your state university will have the same thing. If not, go and talk to someone at the university that you wish to attend who knows the ins and outs of visas etc. If they tell you you have to pay the larger amount, keep making inquiries incase they have it wrong. I was told a few times that I would have to pay the larger amount but kept pushing to get to the right answer. Even then, when my bill came through it came through wrong!

I am off to an open day for 'mature students' next month so will investiagte the fee situation then. Of course this is always the hope that the gc will be processed by then, touch wood.
