Full Version: Working spouse on H1B

Hi,
I was under the impression that the spouse of a H1B Visa holder is not allowed to work.
However, a friend of mine told me that he knows an English guy here on a H1B and his wife is working having obtained a EAD.
He said the rules changed for this a couple of years ago.

Is this true? I remember hearing there was a rule change a couple of years ago but thought that it didnt apply to H1B visa holders.

I'm on an H4 (my husband is on a H1B visa) and no, we're still not allowed to work - in my case it's such a shame wink 8)

I think one of the L visa's changed over the recent years to let spouses work but I'm absolutely no expert on Visas.

As far as I am aware, a spouse on H4 visa is only able to undertake paid employment when you apply for your gc and go through the change of status process as you'll get your Employment Authorisation card.

You definitely cannot work on just an H4. But she could have applied for an EAD off her own qualifications once they arrived here. I know of H1B holders who have spouses who have been able to apply for work because they have sufficient qualifications/work experience to apply for their own visa but I don't know how it works. Whether they have to apply for a separate H1 (I don't seem to remember them saying they did) or whether they go a different route with already having a legal visa for living in this country.
I think they would have to apply for their own H1B visa.....
